The permit requirements for portable restrooms vary widely. Here's what you need to know before you place a unit.

The Short Answer: It Depends

Permit requirements depend on:

  • Location: City vs. county vs. private property
  • Duration: Temporary (days) vs. long-term (months)
  • Placement: Public right-of-way vs. private property
  • Zoning: Residential, commercial, or industrial area

When You DON'T Need a Permit

  • Private property: Your own land, with owner permission
  • Construction sites: Usually covered under building permit
  • Your business: If it's your commercial property
  • Short-term (under 30 days): In many jurisdictions

When You DO Need a Permit

  • !Public streets/sidewalks: Any placement on city property
  • !Parks: Even with event permission
  • !Residential neighborhoods: Some HOA communities
  • !Long-term placement: Over 30-90 days in some areas

Where to Get Permits

Check with these local authorities:

  • City/County Clerk: Main permit office
  • Public Works: For street placements
  • Parks & Recreation: For park events
  • Zoning Office: For long-term permits
  • HOA: For residential community events

Permit Costs

Permit Type Typical Cost
Street placement$25-100 per unit per month
Park event$50-200 flat fee
Long-term (construction)$100-500 per unit
Special event permit$150-500

What Happens If You Skip the Permit?

Don't risk these consequences:

  • Fines: $100-500 per day in many jurisdictions
  • Unit removal: City may confiscate the equipment
  • Event shutdown: Potential closure of your event
  • Legal liability: You're liable if someone is injured
  • Future permits denied: Your organization flagged

All numbers are typical/recent ranges. Actual fees and lead times can change with municipal budget cycles. Always confirm with the relevant department before booking. We file these permits routinely — if you're working in any of these cities, we can handle the application as part of your booking.

HOA and homeowner association rules

Permits aren't the only consideration. If you're hosting on private property in a deed-restricted neighborhood, the HOA may have its own rules:

  • Visibility from the street — some HOAs prohibit any temporary structure visible from public ways. Place behind the house or screened.
  • Duration limits — many HOAs cap temporary structures at 7–14 days. Long construction projects need a separate variance request.
  • Color and finish — some HOAs prefer beige or brown units over the typical green. We can route specific colors on request.
  • Notification — courteous to give neighbors a heads-up before delivery, especially for multi-week rentals. Avoids complaints to the HOA board.

Special-event permits (festivals, weddings on public land)

If your event is on public land (parks, beaches, government property), the porta potty permit is usually bundled with the broader special-event permit:

  • Park & recreation department handles event permits at most municipal parks
  • Health department review may be required for permits with food service (1 hand wash per food vendor minimum)
  • Insurance certificate ($1M–$2M general liability) — usually required as part of the event permit. We provide COI within 60 minutes of booking.
  • Sanitation plan — many cities require a written plan with unit count, ADA placement, and servicing schedule. We supply this on request.

When we file the permit for you

For most municipal permits we work with regularly, we'll file on your behalf as part of your booking. Here's how that typically goes:

  1. You give us the address, dates, unit count, and event type
  2. We pull the right application for that municipality (we have most of them on file)
  3. We submit it through the city's portal under our vendor account
  4. Permit fee is typically pass-through — we charge you the city's fee with no markup
  5. Permit is delivered to your email when issued; physical placard (if required) is at the trailer

For one-off permits in cities we don't typically work in, we'll guide you through the application but you'll file it yourself.
